What Is An Individual Voluntary Arrangements (IVAs)?

An Individual Voluntary Arrangement (IVA) is a formal agreement which allows you to make one affordable payment towards your unsecured debts. An IVA normally lasts for 5 or 6 years.

At the end of the IVA any unsecured debts included in the IVA are written off. Check if you qualify for an IVA.

You must use an Insolvency Practitioner to propose an IVA to your creditors.

Your Insolvency Practitioner works out what you can afford to repay towards your debts. They will then prepare a proposal for your creditors, You will need to provide details of your financial situation, including assets, debts and income.

For an IVA to be accepted, 75% in value of the creditors who vote will have to approve the IVA, we can check to see if you have the right debts to qualify.

Key Facts of an IVA

  • Make one affordable monthly payment towards all your unsecured debts.
  • Once approved, all legal action, including bailiffs is stopped
  • Interest and charges are frozen
  • At the end of the IVA, any unsecured debts included will be written off
  • You remain in control of your assets and will not be required to sell your home or other assets.
  • If your income increases (salary, bonus or overtime) throughout the lifetime of the IVA your monthly contribution may increase
  • Your credit rating will be negatively affected by an IVA for 12 months following the completion of the arrangement.
  • Any debts that can’t be included in your IVA will be your responsibility to pay, for example court fines, student loans or money owed under family court proceedings (these debts will be considered when calculating your expenditure to ensure that payments to these debts can be maintained throughout the duration of your IVA)
  • Failure of the IVA may result in bankruptcy

Fees with an IVA

There are no upfront fees and the following fees will only be charged if your IVA is approved:

  • The Nominee’s fee - The Nominee's fee proposed to creditors will be £1,900
  • The Supervisor’s fee - The Supervisor’s fee is a monthly fee which covers the specialist work carried out to administer your IVA for the duration of the IVA period (typically a 5 year period). This fee will be £1,750. In addition to this, your Supervisor will charge a fee of 15% of Additional Realisations that are not monthly contributions.
  • Both fees will be incorporated into your monthly payment. All fees will be explained to you before you enter any agreement.
